RULES AND REGULATIONS FOR SEMINOLE LAKES PROPERTY OWNERS ASSOCIATION (SLPOA)

(Approved by the POA Board-May 2007)

Purpose of Rules and Regulations

These Rules and Regulations have been developed and adopted for the purpose of establishing a clear understanding of the Declaration of Covenants, By-Laws and Articles of Incorporation, Conditions and Restrictions of the SLPOA in a simplistic and concise manner.

They do not supersede nor contradict the existing governing documents. They were adopted to clarify issues and concerns and to benefit all members of the SLPOA. The term "Governing Documents" as used in these Rules and Regulations shall include the Declaration of Covenants, Conditions and Restrictions, Articles of Incorporation, By-Laws and the Rules and Regulations of the Association. In the event of a conflict between any Governing Documents, the following priorities shall control:

Many of the Rules and Regulations are based upon the requirements of Florida Laws and/or Statutes governing the operation of a Homeowners' Association. They were developed to ensure the protection of your property values, provide safety, and promote a pleasant and enjoyable use of your property and community.

Under all circumstances, City, County, State and/or Federal Laws, Regulations and/or Statutes supersede our Governing Documents.

The Board of Directors shall have the power to adopt and publish rules and regulations governing the use of the common elements and facilities, including the personal conduct of the members and their guests thereon, and to establish penalties for any infractions of such rules and regulations. These Rules and Regulations may be amended as deemed necessary by the Board of Directors to continue and maintain the high standards of the Seminole Lakes community.

Seminole Lakes Property Owners Association (SLPOA):

Every property owner of record is a SLPOA member. In March, an annual meeting of the Association is held to elect members to the SLPOA Board of Directors. The Board consists of a President, a Vice-President, a Secretary, a Treasurer and one Director. Directors are elected for a two (2)-year term, and the terms are staggered to provide continuity. Committees are established by the Board. Current committees are: Access Control, Activities, CERT, Covenants and Governing Documents, Creative Arts, Grapevine, Information Distribution, Insurance, Finance, Lakes and Roads, Landscape and Irrigation, Maintenance, Telephone Book and Elections, Website and E-Mail, and Welcoming. Residents are encouraged to join a committee.

The Board of Directors generally meets on the second Monday of each month at a specified location. Meetings begin at10: 0OAM. Residents are encouraged to attend these meetings. Residents will have the opportunity to speak on any agenda item when the floor is opened for comments by the Board. Comments are limited to three minutes per resident. Residents wishing to have action taken on a matter or have the Board or one of its committees investigate a question or concern may also submit their written, signed request to the Board or committee for consideration. In the decision-making process the Board is guided by the Declaration of Covenants, Conditions and Restrictions, Articles of Incorporation, By-Laws and the Rules and Regulations of the SLPOA.

RULES. REGULATIONS AND RESPONSIBILITIES OF HOMEOWNERS

1. ALLIGATORS

a. DO NOT FEED THE ALLIGATORS. They will lose their fear of humans, thereby posing a threat to people.

b. Pets must be leashed at all times. Allowing your pet to run free and/or walking your pet near the water's edge can attract alligators and may prove to be a threat to your pet.

c. If an alligator is threatening you or your pet, contact Star Management to report the type of threat and the specific location. If the alligator is on a lakeshore, be sure to name the lake and exact shore location. Star Management will then contact the Wildlife Commission and report back to you. A permit for trapping an alligator will be issued only to the Association and only if the Wildlife Commission determines a threat is actually being posed.

2. AMENITIES

         Amended and approved at POA Board Meeting May 11, 2009:
         "
The POA has executed a lease agreement with the Developer for the use of the following amenities: 
         community swimming pool, tiki hut building, and exercise room. These facilities are for use by eligible POA members and their
         guests. A Pool Committee, sanctioned by the Board of Directors, has developed rules governing the use of these amenities and will
         monitor their usage.  The aforementioned rules are posted on the Seminole Lakes website and at the pool for reference.  All persons
         using the pool, tiki hut, and exercise room are required to comply with said rules and regulations.  Failure to do so, may result in
         expulsion from the area and loss of future use.

         The golf course and tennis courts are private property and fee maintained.  Please contact the Pro Shop (639-5440) for membership
         and guest fee information."

3. ANIMAL CONTROL

a. Pets (such as, but not limited to dogs and cats) may not run free at any time. They must be leashed whenever they are outside of the home. A below ground electric barrier or fence approved by the POA Board and installed around the parcel is also an acceptable form of containment.

b. A pet owner must immediately properly dispose of all refuse created by his pet. The owner/ pet walker must have in his possession a means of disposal when the pet is being walked. Waste is to be collected and disposed of in a sanitary manner. Sewers and lakes are not to be used as disposal sites.

c. No animals, livestock or poultry of any kind shall be bred or raised for commercial reasons.

d. No animal or pet shall be left on the lanai or anywhere outside the home when no person is home.

e. No animal or pet shall be kept in such a manner as to constitute or create a nuisance.

4. ANTENNAS / SATELLITE DISHES

Antennas and satellite dishes are permitted by the FCC Rules and Regulations. Antennas and satellite dishes should be located in the rear of the home to reduce visibility. However, if the homeowner presents notice to the POA Board that such placement unreasonably restricts reception and/or is cost excessive, an exception can be granted. In all cases, homeowners must request in writing permission to install any antennas or satellite dishes and in turn receive written approval of the POA Board prior to installation.

5. ARCHITECTURE

Please note that ANY improvement to the exterior of your home or driveway, including, but not limited to, the installation of additional structures, hurricane shutters, landscaping and alterations to the exterior of existing structures including painting, requires the PRIOR written approval of the POA Board via a Request for Approval Form. Costs to remove any unapproved improvement shall be at the homeowner's expense.

6. AVOID VERBAL ORDERS FORM (AVO)

The AVO form, which can be obtained at the Access Control building, has been designed for use by homeowners as a means of communicating in writing, requests and/or concerns to the POA. Examples of such concerns are landscaping, roads, mailboxes, etc. The completed AVO form should be returned to the mailbox at the Access Control building for forwarding to the POA. The POA will process or forward it to the proper channels for processing. The person (s) who submitted the AVO will receive feedback as to action taken.

7. BUSINESSES

No business of any kind shall be conducted in any residence. A business is defined as any activity for remuneration conducted within SLCC that generates non-resident traffic.

8. CONTRACTORS, MAINTENANCE PERSONNEL AND SERVICE PEOPLE

Contractors, maintenance personnel and service people are prohibited from working within Seminole Lakes on Sundays and federal and state holidays. The permitted hours of work will be Monday - Saturday from 7: OOAM - 6: OOPM. The noise, increased activity and additional traffic during the non-permitted time are considered a source of nuisance to residents and therefore not allowed. In case of any emergency during off hours, please alert the Access Control personnel on duty (639-5677). Homeowners are totally responsible for any and all damage to common property done by contractors in their employment.

9. DUMPSTERS

Dumpsters of any kind are not allowed in Seminole Lakes. However, should an emergency or other special situation require the use of a dumpster, contact a POA Board member to obtain temporary approval. Any damage caused by use of a dumpster on Seminole Lakes Roads will be the responsibility of the contractor and owner to repair at their cost.

10. FENCES

No fences of any kind shall be constructed or maintained on any parcel.

11. FISHING

The lakes have been stocked with fish primarily intended for weed control. All fishing should be on a "catch and release" basis to ensure continuing weed control. Only owners of lots on Block E and their guests are permitted to fish in Lake A (the "Big Lake"). Minors should be supervised at all times. All unauthorized fishing should be reported to the Access Control personnel on duty (639-5677).

12. FLAGS

a. When displaying the American flag either horizontally or vertically against a wall or in a window, the Union should be uppermost and to the flag's own right and to the observer's left.

b. The flag of the United States of America should be at the center and at the highest point of the group when multiple flags and/or pennants are grouped and displayed from staffs.

c. It is the universal custom to display the flag only from sunrise to sunset on buildings or on stationary flagstaffs in the open. However, when a patriotic effect is desired, the flag may be displayed twenty-four hours a day if properly illuminated during the hours of darkness.

13. GARAGE DOORS

Garage doors should be closed except for the purpose of allowing a vehicle or other article entrance to or exit from the garage. This provision shall not be construed to disallow the use of a screen enclosure on a garage door. However, such an enclosure must reasonably conceal the interior of the garage from street view.

14. GARAGE SALES

Garage sales are not permitted in Seminole Lakes.

15. GOLF CARTS

a. Florida Statutes (316.2125) require that any golf cart operated between Sunset and Sunrise be equipped with headlights, brake lights, and a windshield.

b. Legal age for operation is 14 years of age.

c. Owners of golf carts must carry liability insurance.

d, Reckless or dangerous operation of golf carts should be reported to the Access Control personnel on duty.

16. LANDSCAPE CONTROL

All landscaping improvements (additions or removals) to your parcel must be approved by the Landscape Committee. A drawing showing designs, proposed plantings, and approximate start and stop dates should be submitted to the Landscape Committee for Board approval prior to starting any improvement.

a. Before planting any trees, bushes, shrubs or other plantings on your parcel, please contact the Landscape Committee to ensure that the aesthetics of the community are preserved.

b. Homeowners wanting to make landscape improvements to the 10 foot easement in front of their property or to the common areas behind their home must submit a drawing showing designs and proposed plantings. This plan is to be submitted to the Landscape Committee for Board approval Including approximate start and completion dates for all proposed work.

c. You must get approval before any plants, trees, etc. are removed from common areas. In many areas, this is a buffer to keep our community secure and cut down on the noise levels.

d. When replacing trees and plants, make sure they are native to Florida as they must be able to withstand the Florida climate and dry or wet conditions.

e. Use mulch, Pine mulch, stone, or cover crops to prevent weeds.

f. When replacing sod, make sure the sod is of the same type previously used and is watered daily for the first two months (water restrictions permitting).

g. Homeowners are responsible for keeping their areas weed free and that all plants and trees are trimmed and water properly.

h. Make sure areas that have to be mowed are clear of debris and any objects that would make mowing and trimming difficult.

i. Curbing around mail boxes and light posts are permitted as well as plants and fill.

j. For any questions, contact the Landscape Committee chairperson.

17. MAILBOXES

a. Once installed, the mailbox and post are the responsibility of the homeowner.

b. Inspect your mailbox and post periodically for wear. As your home occasionally requires a coat of paint, so does your mailbox and post. If the mailbox and/or post require replacement, the Maintenance Committee can be contacted for the name of the supplier.

c. Mail carriers and POA members who make deliveries request that residents periodically inspect mailboxes and posts for wasp nests.

d. To preserve the aesthetics of our community, residents are requested to refrain from placing decals, rain gauges, license plates and/or flags on the mailbox.

18. MONTHLY ASSESSMENTS

Assessments are due the first of each month. Any homeowner delinquent on his monthly payment will be charged interest from the due date. Interest charged will be at the highest rate.

19. NO SOLICITATION POLICY

The deed restrictions of Seminole Lakes prohibit soliciting of any kind. In addition, the City of Punta Gorda has regulations that restrict door-to-door selling/solicitors and peddlers. Any resident observing a violation of this no solicitation policy should contact Star Management (575-6764), the Access Control personnel on duty (639-5677) or the non-emergency number of the Punta Gorda Police Department (639-4111). Please notify a Board member if a resident is soliciting for a business.

20. POST LIGHTS

Photocell post lights are required in Seminole Lakes. They must come on automatically at dusk and go off at dawn.

21. RECREATIONAL VEHICLES, TRUCKS, BOATS AND TRAILERS

a. There shall be no golf carts, recreational vehicles, trucks (including pick-up trucks), boats or trailers parked on any of the parcels and/or the common elements unless golf carts, recreational vehicles, trucks, boats or trailers are parked in an enclosed area and concealed from public view.

b. Guests of property owners are not allowed to drive any of the above- mentioned vehicles or boats into Seminole Lakes.

c. No motorized vehicles of any kind shall be parked on any of the common elements, Tract B or roadways except for the purposes of loading or unloading only.

d. No motorized vehicles shall be parked on the streets of Seminole Lakes between sunset and sunrise.

e. Engine and chassis maintenance are not allowed.

22. RECYCLING PROGRAM

Collection of items to be recycled is on Saturday. Please use the recycle bin supplied by the City of Punta Gorda Recycling Program. Newspapers should be separated from other items and bundled with string or placed in paper bags. All other items in the bin should be rinsed first if necessary.

23. RENTING

No dwelling may be rented for a period less than thirty (30) days or more than twice in any one year. The POA Board approved (5/8/06) Rental Application Policy and Rental Application Request Form may be obtained from Star Management or the Seminole Lakes website.

24. ROOFS

a. All residences shall have tile roofs. Said tile shall be of high quality commensurate with the purpose to develop the property in order to enhance and protect the value, attractiveness and desirability of the parcels.

Amended and approved February 9, 2009 at Board of Directors Meeting:
"#24 Roofs. A. All residences shall have tile roofs. Said tile shall be of high quality (code compliant clay or cement tile, stone coated steel tile, or metal tile, no shingles or flat metal roofs permitted) commensurate with the purpose to develop the property in order to enhance and protect the value, attractiveness and desirability of the parcels. Written approval from ARB must be obtained prior to installation."

b. The Association is permitted to allow the sheltering of open-air lanais with a material different from that of the main residence. An open-air lanai sheltered by a different material will not diminish the value of the parcels within the community and will not be considered contrary to our Declaration of Covenants: Article VI; Section d. (12/2003 attorney opinion)

c. Any resident wishing to enclose an open-air lanai should contact the POA Board for approval.

25. SIGNS

a. No signs, other than those specifically approved by the POA, may be erected or displayed on your property.

b. Temporary "For Sale" and "For Rent" signs are permitted, but there may only be one sign per property, and the size must be no larger than six inches by eight inches.

c. To promote an open house, one sign no larger than six inches by eight inches may be placed at the front of the Seminole Lakes Country Club main entrance. Also, one sign promoting the open house may be placed on the property's front lawn. It can be no larger than six inches by eight inches. No other promotional items may be used or displayed.

d. A realtor may provide maps of Seminole Lakes, available at the Access Control building, with the property (-ies) to be shown so designated. These maps may be given to any visitor requesting entry for the purpose of visiting an open house.

e. Any and all of the materials mentioned above used for an open house must be removed or picked up by the end of the day of that open house.

26. SNOWBIRD OR VACATIONING RESIDENTS' RESPONSIBILITIES

Any resident who will be gone from his home for a two-week period or longer is requested to do the following:

a. Notify the Access Control personnel of your intention to be away.

b. Consider leaving a key to your residence with a neighbor or friend.

c. Leave the name of your insurance agency.

d. Leave an address and/or phone number where you can be contacted.

e. Trim trees and shrubbery, cutting weak branches that could fall against your home or another's home during a serious windstorm.

f. Bring indoors, or adequately secure items such as patio furniture, lawn decorations, flower pots and grills that may blow away and/or cause damage during a serious windstorm.

g. Review procedures listed on the related form available from a member of the Access Control personnel.

27. SOLAR PANELS

The installation of solar panels requires written POA Board approval. Approved panels should be placed, whenever possible, on the rear of the home.

28. SPRINKLER SYSTEMS

a. Sprinkler system controls and timers should neither be locked nor installed within the homeowner's garage.

b. It is the responsibility of the homeowner to test and maintain the sprinkler controls and timers in order to provide appropriate irrigation to the lawn and landscape of the parcel. Sprinkler controls have a back-up battery in the event of power outages. It is important that the battery be replaced on a timely basis to guarantee operation of the system in the event of a power outage.

c. In the absence of the homeowner or when deemed necessary for proper lawn maintenance, the Association has granted Greenscape the authority to enter a parcel to adjust irrigation system controls and/or timers.

29. TRAFFIC CONTROL

SLCC roads are shared by motorized vehicles, golf carts, bicycles, and pedestrians. In order to maintain a safe environment for this mixed use, the POA Board has established a 19MPH speed limit and erected Stop Signs at selected intersections throughout the development. ALL USERS of the roads must observe the speed limit and stop signs. Pedestrians should walk against traffic, as well as wear light colored clothing and carry a flashlight or reflector if using the roads at night.

30. TRASH COLLECTION

a. No rubbish, trash, garbage or waste materials nor garbage or trash containers shall be kept or permitted on any parcel or common element unless enclosed in a walled-in or landscaped area and concealed from public view.

b. Trash is collected every Wednesday and Saturday.

c. Trash should be placed at curbside by 6:OOAM on the day of collection to ensure pickup. Trash may also be placed on your driveway after 6:OOPM on the evening prior to pickup. In all cases, trash must be properly secured to prevent its being strewn by animals or by any other means.

31. TREE, SHRUB AND BRUSH CLIPPINGS

a. All tree, shrub, and brush clippings are collected every Wednesday.

b. No clippings are to be placed on the driveway prior to Tuesday morning.

c. Small clippings and weeds should be placed in a container on the driveway and tree trimmings should be placed on the driveway.

          d. Clippings and cans should not be placed on lawns.

32. VISITORS

During the hours of darkness, visitors to a resident of Seminole Lakes must be pre-cleared for entrance by a phone call from their hosts to the Access Control personnel on duty. If the resident has failed to pre-clear his visitor(s), the visitor(s) will be asked to wait at the entrance gate while the Access Control personnel calls the host resident to obtain clearance. Without such clearance, visitors will not be permitted to enter Seminole Lakes during the hours of darkness.

33. WINDSTORMS AND HURRICANE PREPAREDNESS

a. Trim trees and shrubbery, cutting weak branches that could fall against your home or another's home during a serious windstorm or hurricane.

b. Bring indoors or adequately secure items such as patio furniture, lawn decorations, flower pots and grills that may blow away and/or cause damage during a serious windstorm or hurricane.

c. Consider obtaining a Hurricane Survival Guide, available at a variety of locations or from AAA or Red Cross, and create a disaster plan with one or more neighbors.

34.  COMMON GROUND USAGE:         (Approved POA Board Meeting April 14, 2008)                            

    The Primary intent of the common ground is to further the appearance of a quality community.  Recognizing that little
    recreational space is available, however, limited recreational usage may be permitted under the following conditions:
 

                    a.  Activities must be sponsored by a POA Committee and approved by the Board.

                    b.  A written site plan for the activity must be submitted to the Board with any request.  The Plan should include
                         responsible party, times, setup/takedown schedule, parking plan (golf carts and cars), and any other
                         information the Board may, from time to time, request.

                    c.  The Board may, at its sole discretion, direct that the activity take place at an alternate site (i.e., pool complex,
                         pool lot, or other).

                    d.  No activity will be permitted which alters the physical characteristics of the lot (i.e., mowing, trimming shrubs or
                         in any way changing or damaging the property).

                    e.  No boisterous or loud behavior, which interferes with the quiet enjoyment of adjacent property, is allowed. 
                         Attire appropriate for the event (i.e., shirts) should be worn.

                    f.  Lot must be returned to pre-event condition at the conclusion of the event.  Tents/booths/stakes/trash containers,
                        etc. may not be left overnight on the lot without prior approval.

                    g.  Events should be limited to one per week.
