President’s Report Board Meeting May 11, 2009
I would like to give you an update on the status of Semlak’s lawsuit against Seminole Lakes POA. The issues are extremely complex and Semlak did file a lawsuit against Seminole Lakes last June. Since then we have been in court twice, once when their motion for summary judgment was denied and once when the court ordered mediation after we requested this.
That mediation session is schedule for June 3rd at our attorney’s office in Ft Myers. Attending will be some our directors, our attorney, Semlak representatives and their attorney and a professional mediator who is also an attorney.
The main issues remaining are the exact location of the easement, and our request that Semlak contribute towards the maintenance of our entrance and entrance roads, pay for any removal of the median, and keeping construction trucks off our entrance and exit roads. Semlak has mentioned in one of their court appearances, they would give on the construction truck issue, but this requires a formal agreement. There are other issues and questions that, may surface during the mediation session.
Our attorney and the past board have worked hard to resolve the lawsuit, and our original request for mediation was turned down by Semlak. They are only going into mediation because of the court order. However we will try hard to get the dispute resolved and do believe this will be accomplished at the session.
