Seminole Lakes POA Board Meeting with City of Punta Gorda

Bob Toth thanked the City Officials for meeting with the Seminole Lakes POA Board to address a list of concerns that he had previously emailed and stated that the purpose of our meeting was to review these concerns. Also, we wanted to understand how some of the City’s procedures work. He then proceeded with the Seminole Lakes issues:
HURRICANE DEBRIS
1) Bob Toth inquired if the City would remove debris from our roads after a hurricane? Howard Kunik responded that the City would not enter our subdivision to clean up debris from our roads after a hurricane because they are private roads. He asked if the Police and Fire Departments would come into our community if our roads are blocked during an emergency? Howard Kunik responded, yes, the Fire, EMS, and Emergency vehicles would clear enough debris to pass through the streets. He stated that after we found out the City was not going to clear our roads after Hurricane Charley, we had an option to move the debris to Highway 41. We did not do this because our private contractor was afraid of the risk and liability. If we have another hurricane, would the City pick up our debris if we moved it to Highway 41? Rick Keeney and Howard Kunik responded that yes, the City would pick up any debris moved out to Highway 41. They have that agreement with FEMA that they will reimburse the City for debris pickup moved to rights-of-way.
Bob Toth asked what is the FEMA policy? Is there anything we could be doing to get FEMA’s assistance for the next hurricane? Howard Kunik responded that the FEMA documents are extremely lengthy and nebulous. If we were to use one of the City’s three approved debris removal contractors, there is a slight possibility that we could present justification to the City. The City could petition FEMA on our behalf. However, this could not be done before the disaster; it would have to be done afterwards and the chances of receiving reimbursement are slim.
SEMINOLE LAKES PLAZA – LIGHTS AND NOISE
1) Bob Foiles stated the operation of the plaza continues to cause problems for some of our residents as light pollution and noise are still major concerns. The deflector shields on some of the lights are gone from Hurricane Charley, and we have been unable to get the developer to reinstall them. Dennis Murphy stated he would review the light problem with the developer and get it resolved. He did not know if the noise from the rooftop air conditioners could be reduced but plans to review with the developer. The City is trying to eliminate the "cookie pattern designs" and has set a higher standard for developers. There are still considerable problems with Rudco’s proposals to build on the empty lots as they must meet the city codes. Howard Kunik stated that the City is promoting commercial developments so the tax burden is reduced to homeowners. The Plaza will be expanded but numerous details must be worked out.
DRAINAGE EASEMENT
1) Bob Toth said the Plaza property contains a drainage easement which allows all the water from the plaza to drain into one of our private lakes in Seminole Lakes. Additional water and pollutants draining into the lake will pose potential harm to the quality of the water, as well as the potential for street flooding. Water draining into this lake will come from asphalt parking areas which pose a serious risk to water quality. In a public hearing, the developer said that separate Swiftmud permits would be required for each of the five lots. What is the status of these permits, and will the City ensure that polluted water is pretreated before it enters our private lakes? What guarantee will the City give Seminole Lakes that the additional water pouring into the lakes and roads will not cause flooding in some of our homes?
Dennis Murphy said developers cannot get building permits without SWIFTMUD approving changes to the drainage system. However, the original permit may not require changes if there are no changes to drainage system. There may have to be five separate permits if the lots are sold off individually and that would require revised permits. The City will locate the Master Permit to see what is defined about pre-treatment. Pre-treatment may mean holding water in a retention basis for 24 hours before draining out. Dennis Murphy recommended Seminole Lakes get test results of the water quality of our lake for future reference to determine if the water quality is being degraded due to the plaza expansion. He suggested we check with our attorney regarding water treatment costs because this may have been part of the original development; therefore, Rudco must pay their fair share.
Bob Toth said Seminole Lakes already has test results of the water quality of the lakes, and he has contacted SWIFTMUD for details on the existing permit. We would expect pre-treatment of the water to include separators and filters. Seminole Lakes is disturbed that our deed does not include any easements on our property.
LIFT STATIONS
1) Bob Toth stated that we have three (3) lift stations in Seminole Lakes which are maintained by the City. During extended power outages, does the City have a plan to keep these operating through the use of generators? Rick Keeney stated the City will bring generators, if required, and their "first in team" enters the community after an "event" to assess the situation. The City now has 17 generators which is many more than they had before Hurricane Charley.
EASEMENT
1) Bob Toth advised that the developer, Rudco Properties, stated at the March 27, 2006 Planning Commission that one of their approved steps was a connector street that extended south in front of the existing stores and connected to the entrance of Seminole Lakes in front of our Guard House. Seminole Lakes residents do not want a road from the plaza entering our private roads. There is concern about the volume of cars and the possibility of having to remove an established median. We do not favor the Plaza using our entrance roads to enter the Plaza. Will the City support our views? Dave Hilston said he thought the use of an easement would be beneficial to the residents as they could enter the Plaza using their golf carts. Any use of the road would require City input and perhaps a traffic study. If the median had to be removed, the developer would have to pay those costs.
Bob Toth thanked the City officials for their time and providing answers to our various concerns. The meeting adjourned at 2:45 pm.
